In order to assess the implementation of business registration under Law on Enterprises 2020, on December 15, 2022 in Hanoi, The Department of Business Registration Management, Ministry of Planning and Investment cooperated with LinkSME Project sponsored by U.S. Agency for International Development (USAID) to organize the Conference "Assessing the implementation of business registration under Law on Enterprises 2020".
Attending the seminar were Mr. Bui Anh Tuan, Director of The Department of Business Registration Management, Ms. Nguyen Thi Viet Anh, Deputy Director of The Department of Business Registration Management, Mr. Daniel Fitzapatrick, Project Director of USAID LinkSME and representatives of some business registration agencies, tax authorities, representatives from law firms, consulting firms, law offices and press agencies.
Law on Enterprises No. 59/2020/QH14 was approved by the National Assembly on June 17, 2020, took effect from January 1, 2021 and has quickly come to life.

Speaking at the opening of the workshop, Director Bui Anh Tuan said that the report evaluates the implementation of business registration in accordance with Law on Enterprises, thereby continuing to propose and recommend solutions to improve business registration in Vietnam. Through reviewing and evaluating the practice of implementing business registration, surveying opinions of enterprises and business registration agencies, the expert group has made assessments of strengths, weaknesses, advantages, difficulties and problems of business registration in the past time, thereby proposing solutions and recommendations to improve business registration in the coming time.
The workshop heard the main results of the Report "Assessment of the implementation of business registration under Law on Enterprises 2020 and proposing solutions to continue reforming administrative procedures related to business registration" . The expert group has summarized the specific studies on some contents of business registration implementation in recent years in terms of organizing the implementation of the legal framework on business registration; information technology system in service of business registration; coordinate among state management agencies in implementing business registration; administrative procedures for business registration; publicize business registration information in order to improve the transparency of the investment and business environment.

At the Workshop, Mr. Daniel Fitzapatrick, USAID LinkSME Project Director appreciated that Agency for Business Registration organized a Workshop to collect comments on how to collect comments on how the Business registration system is operating to serve individuals and businesses. Recently, business registration is actually easier now than it was 5 years ago. Most of the registration steps have become easier, although there may be ways to simplify business registration, some will object to this for reasons of state security, or protection of priority rights of Vietnamese citizens, serving the Government's needs in collecting information and effectively regulating and managing commercial activities. There is one area where we are approaching a general consensus, that is digitization, development of e-Government. This is an exciting field that offers the opportunity to make real breakthroughs to create a business-friendly environment in Vietnam, emphasized Mr. Daniel Fitzapatrick.

Discussing the business registration situation and giving comments on the Report, on the post-examine issue, Mr. Phan Duc Hieu, Standing Member of the Economic Committee of the National Assembly highly appreciated the information and findings in the Report and express opinions on the purpose of post-examine: to assist enterprises to better understand the law and comply with the law. At the same time, it is necessary to have an equal movement of all agencies to coordinate, raise awareness of the entire society and relevant agencies about the entire content of Law on Enterprises. Agency for Business Registration needs to prioritize training and communication for businesses to help businesses understand the essence of the entire content of Law on Enterprises.
Le Thi Duyen Hai, Director of the Declaration Department, General Department of Taxation, said that in the coming time, it is necessary to have a database to store full information on the operation situation, historical violations of enterprises to forecast trends, classify risks, and compliance of enterprises at high, low, and medium levels to monitor enterprises during their operation.
