On December 16, 2022, Agency for Business Registration held a conference to summarize the work in 2022 and the mission direction in 2023. Deputy Minister Tran Duy Dong attended and directed the conference.
The conference aimed to summarize and assess the situation and results achieved in 2022 as well as identify the challenges and limitations that need to continue improving in the coming time. Attending the conference were the representatives from the Party Committee, The Department of Organization and Personnel, Ministry Office, Trade Union of the Ministry of Planning and Investment and all officials, public employees and contract workers of Agency for Business Registration.

In 2022, with the close attention and direction of the Ministry leaders, along with the close coordination of the units in the Ministry and the positive contributions of the Department's staffs as well as the entire of the business registration management agency system in localities across the country, the work of the functions and tasks assigned to the Department has been implemented comprehensively to meet the goals and requirements set out, contributing to improvement business environment, promoting enterprises to enter the market.
Presenting briefly of the summary report in 2022 and the mission direction in 2023, Director Bui Anh Tuan said that in 2022, it was an important year, confirming the process of recovery and development after the pandemic Covid-19. Our country has achieved remarkable achievements, basically maintaining macroeconomic stability, controlling inflation, ensuring great balance in the context of the world is very complicated, unpredictable and different from the time of developing the socio-economic development plans in 2022 and Resolution No. 01/NQ -CP.

From the beginning of the year until now, the world economic context has faced many challenges, the economy contained many instability; investment, trade declined, and the signs of global economic recession increasingly cleared. The complicated interwoven risks such as Russia-Ukraine conflict, climate change, the consequences of Covid-19 epidemic, etc. have affected the recovery process of the economy after more than 2 years of being heavily affected by Covid-19 epidemic. The complicated fluctuations of the world's economic and political situation also caused negative and difficult impacts on domestic production and business activities.
In that context, on the basis of the assigned tasks and to contribute to supporting businesses to overcome difficulties, in 2022, Agency for Business Registration has focused on drastically implementing and enactments the directs of the National Assembly, the Government, the Prime Minister and the Minister in documents, including: Resolution No. 01/NQ-CP dated January 8, 2022 of the Government on the pivotal tasks and solutions to implement The socio-economic plan and annual state budget estimates; Resolution No. 02/NQ-CP issued on January 10, 2022 of the Government on continuing to perform the main tasks and solutions to improve the business environment, improve national competitiveness; Resolution No. 131/NQ-CP issued on October 6, 2022 of the Government on promoting administrative procedure reform and modernizing the direction and administration method to serve the people and businesses; Directive No. 01/CT-BKHDT of the Minister of Planning and Investment, etc.

In 2022, the Department has positively and actively implemented tasks with the goal of solving difficulties and obstacles for businesses in the process of entering the market, encouraging start-up businesses through building the main policies to simplify administrative procedures, apply information technology to reduce time, costs and support businesses in the implementation of procedures and comply with the law on business registration, specifically: To complete the legal framework for enterprise registration, cooperative economic organizations, business households; To promote the application of information technology, expand connections, share data with information systems of state management agencies contributing to improve the business environment, building e -government; To support and guide units, organizations, individuals and localities to implement the application of business registration regulations; To analyze, provide and share timely information on enterprise registration for macro-policy making and social needs; To implement the state management of enterprises after registering to establish, to handle complaints, denunciations, reflections and petitions of the people and enterprises.

The report stated a number of results achieved in 2022. Firstly, with the drastic direction of the Government, the Prime Minister and the Ministry leaders in implementing Resolution No. 01/NQ-CP, Resolution No. 02/NQ-CP and a series of other synchronous solutions, Agency for Business Registration has basically completed the tasks assigned with many positive results, including reducing time, cost of starting the business of the enterprises, contributing to improving the business investment environment in our country. These contributions have been recognized by the business community as well as international organizations.
Secondly, fulfilling the role as the central focal point directly directs, guides and supports the provincial and district business registration agencies to ensure the completion of the tasks set out and ensure the work of business registration is continuous, smooth and convenient for businesses.
Thirdly, promoting digital conversion, upgrading applications based on the e-government architecture framework version 2.0, sharing data connection with ministries, agencies and localities has opened up more opportunities In accessing and exploiting information, and increasing the publicity and transparency of information, simplifying administrative procedures. In addition, the expansion of the scope of applications for other objects other than businesses such as cooperatives and expected in the coming time is business households, contributing to building a favorable business investment environment, for fair handling for all types of economic organizations. At the same time, the effective application of information technology in the field of business registration will be spread, which is a good practice for other fields.

Fourthly, continue to maintain and develop good relationships with relevant agencies in exchanging and providing information to improve and unify the database of enterprises, as a basis for lifting efficiency of state management of enterprises; Continuing to affirm the role as a focal point for summarizing information on enterprise registration to promptly and fully reflect the legal status of the business, meet the requirements of the Ministry leaders, organizations, individual.
In addition to the achievements achieved in 2022, the Department also seriously acknowledged and pointed out the shortcomings and limitations that require all civil servants, officials and employees of the Department to strive and distribute a spirit of solidarity, unity, overcoming all difficulties and challenges and proposing solutions to overcome.
About post-inspection
In the context of the legal framework of enterprises that are reformed in an open direction and create maximum favorable conditions for the development of the business, the role of post-inspection is becoming more important; However, the reality shows that, at present, the post-inspection is revealing many limitations. Tools and post-inspection forces in localities have not been paid attention, arranged commensurate with the role, tasks, lack of both force and quality, so the efficiency is not high.

Regarding the management of business household registration
Business households are a large number of entities and an important contribution in the economy, but have not been paid enough attention in policy making. Data on business households is incomplete, there is no unified database on business household registration nationwide. In addition, the order and procedures for business household registration have not had the cooperation between business registration agencies and district tax authorities. That led to the fact that state agencies did not capture the timely information leading to violations of the law or failed to comply with the obligations of these subjects, and at the same time, causing difficulties in synthesizing, analyzing and assessing information for building policies and regulations to support business households in the process of entering the market and business activities.
The results of the survey report in 49 provinces and cities showed that the provincial and district business registration agencies were using different software to manage business households; some places do not have special software for business household management but only manage on Excel files. Therefore, it is necessary to have synchronization and unity between business household management software. Most localities want to build a general system of individual business households in the country in the direction of connecting with the tax authorities in order to improve the efficiency in receiving, processing and monitoring business household registration, meeting the requirements in state management.
Regarding information technology application
The information technology has not been applied widely in coordination, sharing information and data on businesses between ministries and specialized management agencies. In some areas, the level of information technology application is still low, leading to difficulties in implementing electronic interconnection mechanisms in solving administrative procedures of the business as well as sharing information for post-inspection.

Currently, most of the equipment of the National Information System on Business Registration is old and degraded, so there is always a potential risk for the System; applications still operate on old technology platforms from many years ago, so they face many difficulties in modifying, upgrading and optimizing applications.
Regarding the handling of complaints and petitions
Through monitoring and handling complaints and petitions, it was found that some complaints were sent by individuals using incorrect and bogus names and addresses, leading to a situation when the authorities had The reply text is returned by the post office, which takes a lot of time and effort of officials and state management agencies, etc.
In order to successfully complete the assigned tasks, Department of Business Registration Management is expected to continue implementing a number of tasks in 2023 as follows:
Firstly, continue to improve the business environment, complete the assigned contents in Directive No. 01/CT-BKHDT on the implementation of the Government's Resolution No. 01/NQ-CP as well as with other tasks assigned by the leaders of the Ministry, ensuring quality and progress, especially, focusing on guiding the implementation of Law on Enterprises and guiding documents to ensure a favorable business environment for the maintenance of operations and the restoration of production and business activities of enterprises.
Secondly, continue to improve the legal framework on registration of enterprises, cooperative economic organizations and business households; well perform its role as a professional directing and guiding agency on business registration nationwide: assume the prime responsibility for, and coordinate with the Ministry of Finance, Ministry of Justice, Public Security, the Office of the Government Department of Administrative Procedures Control) to develop a Circular amending and supplementing Circular No. 01/2021/TT-BKHDT dated March 16, 2021 of the Minister of Planning and Investment guiding on enterprise registration; Continue to contribute ideas and preside over the completion of content related to the registration of cooperative economic organizations in the Law on Cooperative Project (amended); develop guidelines on registration of cooperative economic organizations in the Draft Decree detailing the implementation of the Law on Cooperatives (amended); To assume the prime responsibility for, and coordinate with relevant agencies and units in, formulating the Draft Decree on business households; assume the prime responsibility for, study and propose plans to amend and supplement relevant legal documents to meet the requirements of connecting and sharing data with the National Population Database in order to simplify streamline business registration procedures, business household registration; assume the prime responsibility for or participate in the development of a legal diagram for the implementation of components related to the registration of cooperative economic organizations in the Law on Cooperative Project (amended) on the National Information System on Cooperative Registration; Training and guidance on business registration, cooperative economic organizations, business households for organizations and individuals.
Thirdly, provide timely and quality information on the development situation of enterprises; research and propose solutions to support businesses, solutions for economic recovery and development after the COVID-19 epidemic.
Fourthly, organize the inspection and supervision of business registration operations in accordance with the law, ensuring the observance of regulations on management in the management of business registration of relevant agencies, organizations and individuals in order to contribute to improving the efficiency of the state management of business registration. At the same time, prevent and promptly detect errors, weaknesses, corruption, harassment and wastefulness in business registration activities; continue to perform the task of summarizing the implementation of the Regulation on coordination in enterprise management after registration for establishment in the provinces and centrally-run cities.
Fifthly, perform well the propaganda, provide timely information to the press to orient public opinion about the achieved results, especially updated information on the business registration situation, the revolutions in business registration, disseminating new legal regulations towards people and businesses, contributing to raising awareness and reducing pressure in inspection and examination; strengthen propaganda for people and businesses on "safe, flexible response and effective control to the epidemic", ensuring continuous and smooth production and business activities.
Research and propose options to promote the improvement of business investment environment, improve business start-up procedures, thereby creating favorable conditions for enterprises to enter the market; implementing international cooperation activities: actively exchanging experiences on the basis of being an official member of CRF; participate in the activities of the ASEAN Special Working Group on Entrepreneurship; carry out other international cooperation activities.

Sixthly, to maintain the national business registration information system to operate stably and safely, to ensure the system's readiness for future legal changes; deploying and upgrading the National Information System on Business Registration to carry out the business registration and tax registration procedures for business households; implementing activities to promote the Information Portal's promotion. Continue to deploy, perfect and expand the service of providing enterprise information with a variety of information products and services. Coordinate with ministries and sectors to research and develop plans to expand data connection between the National Database on Business Registration and the National Database on Population, thereby eliminating the composition of the citizen's personal identification papers and the simplification of the citizen information that needs to be declared in the enterprise registration dossier; connect and share information with the National Cybersecurity Monitoring Center.
Seventhly, complete the functions and tasks of Agency for Business Registration consolidating the organizational structure of the Department and its units after the Department's functions and tasks are promulgated.
At the Conference, delegates actively discussed and contributed ideas to the draft Report, thereby proposing solutions to effectively implement key tasks in the coming time.

Speaking to direct at the conference, Deputy Minister Tran Duy Dong acknowledged, praised and highly appreciated the efforts, efforts and outstanding results achieved by Agency for Business Registration. The report has shown determination and efforts to successfully complete the set tasks, especially in the context of the ongoing Covid-19 epidemic. To further promote the achieved results, the Deputy Minister emphasized a number of tasks, in which focusing on a number of key tasks:
(1) The Department should focus on institutional building, including reviewing mechanisms and policies related to registration of enterprises, cooperatives, and business households in a timely manner, and reporting on completion of regulatory amendments, soon develop a Decree on business households, submit to the Minister for promulgation a Circular amending and supplementing a number of articles of the Minister's Circular No. 01/2021/TT-BKHDT dated March 16, 2021of The Ministry of Planning and Investment provides guidance on business registration, thereby serving as a basis for connecting business household registration - tax registration, actively coordinating with other units to build and complete the legal basis of investment and business management.
(2) Post-inspection should be considered as a key task, applying information technology in post-inspection work, amending regulations on sanctions to ensure the problem of upgrading the household business system, meeting the running checking schedule. Any problems should be reported to the leadership of the Ministry for resolution
(3) Continuing, further research, analysis and monthly business registration situation requires consultation with associations and enterprises to get an overall picture of enterprises, demonstrating the role of economic advisors - society.
At the same time, continue to closely coordinate with units in the Ministry, promote professional work, strengthen solidarity, continue to promote and solidify the achieved results, overcome shortcomings and limitations, and be determined to strive to successfully complete the assigned tasks in 2023./.
